A note on what changes and what doesn’t
The legal eligibility requirements for Spain’s Digital Nomad Visa (income threshold, remote employment standard, apostille and translation rules) are set by Ley 28/2022 (Startups Law) and apply uniformly across every consulate and the UGE. What varies by consulate is the operational layer: how you book your appointment, which payment methods are accepted, how documents must be organized, and how your passport is returned. Jurisdiction: who must apply in New York?
Spanish consular jurisdiction is strictly enforced based on legal residence, not mailing address or where you happen to be physically located. The New York Consulate covers five states:
- New York
- New Jersey
- Connecticut
- Delaware
- Pennsylvania
To establish jurisdiction you provide an original and a clean photocopy of a state-issued photo ID, a driver’s license or state ID card, showing your address in one of these five states. If your ID is issued by another state, you must apply through the consulate serving that state, regardless of where you are physically on the day of your appointment.
Non-U.S. passport holders: Foreign nationals residing in NY, NJ, CT, DE, or PA must provide the original and a clean photocopy of their U.S. Permanent Resident Card or a valid long-term U.S. visa. B1/B2 tourist visas are generally not accepted as the basis for a consular visa filing in the United States.
New York Consulate vs. applying in Spain: which route is right for you?
If you qualify under the New York jurisdiction, you have two legal paths to the same permit. They are not equivalent:

For most clients, the in-country attorney-filed route wins: three years instead of one, no appointment scarcity, and the Startup Law’s positive administrative silence rule protecting you if the UGE is slow. The New York consulate route makes sense if you genuinely cannot travel flexibly right now, your Schengen days are nearly exhausted, or you want the visa foil in hand before uprooting your life in the tri-state area. It is a legitimate route, just usually second-best.
Before you book your appointment
The most common cause of a wasted BLS appointment is documents that expire before the submission date. Your FBI background check has to be recent on the date you actually hand over the dossier, not the date you ordered it. Plan for under three months. If the federal apostille process runs long, that window can close faster than expected. Plan your sequencing before you book.
Booking your BLS appointment
Applications in the New York jurisdiction are scheduled through the BLS International Spain USA portal:
- Individual slots: Each applicant, including spouses and minor dependents, must book a separate appointment slot under their own name.
- Peak season: Availability tightens between roughly April and September due to student visa volume. Book outside that window if your timeline allows.
- No intermediaries: BLS has issued notices that appointments booked through unauthorized third-party brokers are subject to cancellation. Book only through the official portal.
- Lead time: Monitor availability one to two months before your target submission date.
Application process: the sequence
- Document preparation: FBI check ordered through an FBI-approved channeler; federal apostille obtained from the U.S. Department of State in Washington D.C. (not a state apostille office). Allow 3–4 weeks for this step.
- Sworn translations: Official records in English translated by a MAEC-certified sworn translator (traductor jurado). The consulate’s current list says which other documents it wants translated. Your attorney or a specialist agency coordinates this.
- BLS appointment booked: Log in to the BLS portal, select the correct visa type, and reserve your slot well in advance of your target date.
- Dossier assembly: Organize originals and photocopies into two distinct stacks. Confirm the current accepted payment method directly with BLS before your appointment.
- Submission at BLS New York: Attend your appointment, deposit your passport, and pay consular and BLS fees at the center.
- Consular review: The Consulate General evaluates the file; processing typically takes 15–45 days.
- Passport return: Collected in person or returned by courier. If approved, your passport comes back with the 1-year visa foil.
Document formatting at BLS New York
- Two organized stacks: Present two complete, mirrored sets, one stack of originals and one matching stack of clean photocopies. Do not interleave originals and copies.
- FBI check validity: Plan for it to be under three months old on your submission date, with a Washington D.C. federal apostille and a sworn translation attached. A state-level apostille or notary stamp does not satisfy the federal apostille requirement for the FBI check.
- Passport photo: One passport-format photo attached to the National Visa Application Form as specified in the current BLS instructions.
- Payment: Verify the accepted payment method directly on the BLS portal or with the center before attending. This has varied over time and differs from other consular posts.
- Passport return: Confirm current collection and courier options when booking your appointment.
Pre-appointment checklist
- Printed BLS appointment confirmation letter
- Proof of residence in NY, NJ, CT, DE, or PA: original + clean photocopy of state-issued driver’s license or ID
- Original passport (valid at least 1 year beyond your expected stay) + clean photocopy of biometric data page
- National Visa Application Form, completed, signed, and with passport photo attached
- FBI background check: with federal apostille + sworn translation, under three months old at submission
- Signed personal declaration of no criminal record covering the last 5 years
- Employer/client documentation: remote work authorization letter, service contracts, Certificate of Incorporation
- Proof of income: paystubs, bank statements, or invoices meeting the 2026 threshold
- Compliant health insurance: policy certificate from an authorized Spanish insurer, no copays, no annual ceiling
- Authorized payment for consular and BLS fees (verify current accepted methods before attending)

How early should I book my BLS appointment?

Can I travel while my passport is at the consulate?
No. Your physical passport is retained for the entire review period. International travel requiring a passport is not possible until it is returned, with the visa foil if approved, or as-is if the application is denied or withdrawn.
Can I apply at a different Spanish consulate in the U.S.?
No. Consular jurisdiction is strictly enforced based on your state of legal residence at the time of application. If your state-issued ID is from outside the New York district (NY, NJ, CT, DE, PA), you must apply through the corresponding consulate.
What if I move to another state before my appointment?
If you change your legal residence before submitting, you will generally need to apply through the consulate serving your new state. Verify this against current consular instructions before your appointment date.
What happens after I arrive in Spain with my 1-year consular visa?
You can apply for a 3-year residence authorization from inside Spain before the 1-year visa expires, provided you continue to meet all requirements under Ley 28/2022. The in-country renewal process is similar in scope to the original application.
